Private Corporate CISPA's New Language Changes Nothing About Privacy - The Private Government Works In Breach Of Trust :)


CISPA was passed behind closed doors by the House Intelligence Committee, and by a wide margin. There are new amendments in the language about CISPA affecting citizens' personal privacy...but really, the amendments do very little. A lot of it is just verbage that makes the passage more confusing and lengthy. But when the CISPA amendments get into personal privacies, there are plenty of loopholes and outs readily visible that gives government agencies "an out" if they wanted to go ahead and share any of our private data.

So, what does this mean? Why does CISPA keep coming back, despite virulent public outcry?

Title: Privacy Integrated Queries: A Programming Language for Differentially-Private Computation

Abstract: Large volumes of sensitive data are currently collected by an array of agencies, companies, and other organizations. While these data clearly hold great potential for analysis, they can also reflect sensitive information about their participants. Scientists have struggled with the tension between extracting valuable statistical information from these datasets without accidentally disclosing specifics of individual records.

A recent privacy criterion, differential privacy, formally constrains the disclosure of specifics of individual records, without precluding the release of statistical information. Differential privacy requires that the outcome of a computation be almost as likely with and without any one record; to each participant, the analysis behaves as if it did not have access to the participant's data.

While differential privacy is very strong, its use to date has been restricted to privacy experts; a small collection of highly-trained individuals who, no matter how motivated, are not able to satisfy the enormous volume of the world's data analysis needs. To this end, we have assembled a programming language in which any program provides differential privacy, without requiring an expert privacy analysis. The language is almost identical to LINQ, a SQL-like extension to C#, and is readily useable by analysts with only a modest background in programming. We will discuss the design, implementation, and application of this language across a variety of data analysis contexts.

Bio: Frank McSherry is a researcher at Microsoft Research's Silicon Valley lab. His research focus is on large scale data analysis, with a recent focus on issues of privacy and confidentiality. In particular, he helped to develop the recent definition of Differential Privacy, and designed and implemented the Privacy Integrated Queries data analysis platform providing these guarantees.

Title: Privacy, Audit and Accountability

Abstract: Privacy has become a significant concern in modern society as personal information about individuals is increasingly collected, used, and shared, often using digital technologies, by a wide range of organizations. To mitigate privacy concerns, organizations are required to respect privacy laws in regulated sectors (e.g., HIPAA in healthcare, GLBA in financial sector) and to adhere to self-declared privacy policies in self-regulated sectors (e.g., privacy policies of companies such as Google and Facebook in Web services). We investigate the possibility of formalizing and enforcing such practical privacy policies using computational techniques. We formalize privacy policies that prescribe and proscribe *flows* of personal information as well as those that place restrictions on the *purposes* for which a governed entity may use personal information. Recognizing that traditional preventive access control and information flow control mechanisms are inadequate for enforcing such privacy policies, we develop principled audit and accountability mechanisms with provable properties that seek to encourage policy-compliant behavior by detecting policy violations, assigning blame and punishing violators.

We apply these techniques to several US privacy laws and organizational privacy policies, in particular, producing the first complete logical specification and audit of all disclosure-related clauses of the HIPAA Privacy Rule.

Short Bio: Anupam Datta is an Assistant Research Professor at Carnegie Mellon University where he has appointments in CyLab, Electrical & Computer Engineering, and (by courtesy) Computer Science Departments. His research focuses on the scientific foundations of security and privacy. Dr. Datta has authored a book, over 40 publications, and presented numerous seminars on programming language, logical, and algorithmic methods for privacy, software system security, and cryptographic protocol analysis and design. He serves on the Steering Committee of the IEEE Computer Security Foundations Symposium, and has served as Program and General Chair of several meetings on security foundations and on the program committees of top security and privacy conferences. He participates in the NSF TRUST center on security and the HHS SHARPS center on healthcare security and privacy. Dr. Datta obtained PhD and MS degrees from Stanford University and a BTech from IIT Kharagpur, all in Computer Science.

Google, Facebook, Twitter, and other Internet companies and e-mail providers will be prohibited from making legally binding promises to protect your privacy, thanks to a vote this afternoon in the U.S. House of Representatives.

By a 5-8 vote, the House Rules committee rejected a bipartisan fix to the CISPA data-sharing bill that would have ensured companies' privacy promises -- including their terms of use and privacy policies -- remained valid and legally enforceable in the future.

The vote came after Rep. Pete Sessions, a Texas Republican who's the committee's influential chairman, urged his colleagues to vote against the amendment (PDF). All of the committee's eight GOP members voted against the amendment, and all the Democrats supported it. (See CNET's CISPA FAQ.)
It also came hours after a formal veto threat from the Obama administration, citing privacy and other concerns about CISPA. A House floor debate is scheduled to begin tomorrow, which now will not include a vote on the amendment.

"We're disappointed that such a commonsense reform won't even get a vote," Will Adams, a spokesman for Rep. Justin Amash, a Michigan Republican who co-sponsored the amendment, told CNET this evening. "When Americans sign up for service with their phone company or their Internet provider they should be entitled to the privacy protections that the companies promise them. Giving companies legal cover to break their contracts with consumers is bad policy and a disservice to the American people."

Congress should have been able to debate the amendment this week because it would ensure Americans' privacy rights, said Rep. Jared Polis, a Colorado Democrat and former Internet entrepreneur. That includes, he said, the rights of "users who have given their information to the company under the explicit assurance of the terms of use that it wouldn't be shared."

Otherwise, Polis said, CISPA means Internet and other companies will be "completely exonerated from any risk of liability" if they open their databases with confidential customer information to the feds and even private-sector firms.

The amendment was only six lines long. It would have altered the latest version of CISPA (PDF) by saying the legislation does not authorize a company "to breach a contract with any other party," including a terms of service agreement.

If it had been adopted during the floor debate, it would have allowed e-mail providers, social networks, and other companies to pledge not to share customers' confidential information with the National Security Agency, Homeland Security, or any other organization under CISPA -- and made that pledge legally enforceable in court.

CISPA is controversial because it overrules all existing federal and state laws by saying "notwithstanding any other provision of law," including a privacy policy or terms of service agreement, companies may share certain confidential customer information "with any other entity, including the federal government." It would not, however, require them to do so.

That language has alarmed dozens of advocacy groups, including the American Library Association, the American Civil Liberties Union, the Electronic Frontier Foundation, and Reporters Without Borders, which sent a letter (PDF) to Congress last month opposing CISPA. It says: "CISPA's information sharing regime allows the transfer of vast amounts of data, including sensitive information like Internet records or the content of e-mails, to any agency in the government."

A representative for House Intelligence Chairman Mike Rogers (R-Mich.), CISPA's primary author, did not immediately respond to questions from CNET this afternoon.

Other amendments that were approved for discussion during the floor debate include one (PDF) that restricts when federal agencies may vacuum up library records, firearm-sales records, educational records, and medical records. Another (PDF) says CISPA will not authorize the NSA or any other spy agencies "to target a United States person for surveillance."

A reprise of 2012?
Last year, a similar coalition mounted an attempt to defeat CISPA. It failed: despite a presidential veto threat and opposition from Ron Paul (R-Tex.) and many of the same critics who offered amendments this week, the House of Representatives approved the measure by a largely party line vote of 248-168. The bill did not, however, receive a vote in the Senate because of wrangling over a Democratic-backed bill with different privacy problems, and it never became law.

A House committee approved CISPA last week without four key privacy amendments sought by opponents that would have curbed the National Security Agency's ability to collect confidential data.

CISPA's advocates say it's needed to encourage companies to share more information with the federal government, and to a lesser extent among themselves. A "Myth v. Fact" paper (PDF) prepared by the House Intelligence committee says any claim that "this legislation creates a wide-ranging government surveillance program" is a myth.

Rep. Adam Schiff (D-Calif.), who voted against the bill during last week's House Intelligence meeting, said at the time he was "disappointed" that his proposal was overwhelmingly rejected by his colleagues.
"It is not too much to ask that companies make sure they aren't sending private information about their customers, their clients, and their employees to intelligence agencies," Schiff said.

Unlike last year's Stop Online Piracy Act outcry, in which Internet users and civil liberties groups allied with technology companies against Hollywood, no broad alliance exists this time. Companies including AT&T, Comcast, EMC, IBM, Intel, McAfee, Oracle, Time Warner Cable, and Verizon have instead signed on as supporters.

There are some exceptions. As CNET reported last month, Facebook has been one of the few companies to rescind its support. Microsoft has also backed away. Google has not taken a public position.

Mario Rodriguez, a faculty member at Stetson University in the Communications and Media Studies department, maintains a research specialization in social networks brings an innovative perspective to our Communication Studies curriculum. This specialization helps students develop professionally while they learn to critically evaluate social media. His particular emphasis on privacy is not only relevant to the job market; online privacy is an essential topic for cultivating 21st century media literacy. Moreover, social media privacy is a useful framework for discussion of participatory democracy and human agency. It involves intercultural collisions and questions of culturally diverse representation online.

College students should dare to be significant, but the wrong kind of online presence could significantly damage changes of landing a job. IN the contemporary media landscape, seniors graduating from college must negotiate an undulating terrain of Facebook privacy, something that even the savviest privacy experts can have difficult staying up-to-date with. Mario interviewed college seniors about their Facebook privacy as they approached graduation to understand how this particular group strategically controlled what they revealed about themselves online. While overall privacy settings increase on Facebook during the senior year, attitudes varied in subtle ways regarding personal information. Despite this, interviewees were more concerned about the privacy of their pictures on Facebook than their words and commentary, which nevertheless leave their own virtual trail. Many believed they had sufficiently protected Facebook privacy for the job search, bringing up the possibility of a "third-person effect" on Facebook.

CISPA, the controversial bill that greatly threatens the privacy of anyone online, is making its way to Congress after passing in a closed-door vote by the House Intelligence Committee by a huge margin. Mitchell Joachim is a Co-Founder of Terreform ONE and Terrefuge in Brooklyn, NY. He earned his Phd from Massachusetts Institute of Technology (MIT), MAUD Harvard University, M.Arch. Columbia University, BPS SUNY at Buffalo with Honors. He is an international leader and innovator in ecological design and urbanism. He specializes in adapting physical and social ecological principles to architecture, urban design, transport, and environmental planning. His passions include Cities Ecology and Mobility. A former architect at Gehry Partners, and Pei Cobb Freed, his work has revolutionized urban architecture.

He has been awarded the Moshe Safdie Research Fellowship, and the Martin Family Society Fellow for Sustainability at MIT. He won the History Channel and Infiniti Excellence Award for the City of the Future. His project, Fab Tree Hab, has been exhibited at MoMA and widely published. He was selected to be the Frank Gehry International Visiting Chair in Architectural Design at the University of Toronto for 2009-2010. Mitchell has also won the TED2010 Fellowship.
